Vendor Terms

1. Description of the Service

Flashmob Market (flashmob.market) is an online intermediary platform operated by Remény Farm Kft. that allows local food producers to showcase their products and receive reservations based on the REKO model.

The platform is free for producers — zero commission, zero platform fees. A reservation received through the platform and its confirmation do not constitute an online sale contract. The sale contract is concluded between the producer and the buyer at in-person pickup, with payment made on site.

2. Producer Registration and Approval

• Creating a producer account requires registration and administrator approval.
• By registering, the producer declares that their activities comply with applicable Hungarian legislation, in particular:
  • Food safety regulations (NÉBIH)
  • Tax obligations (NAV)
  • Consumer protection rules
• By registering, you accept these seller terms, the Terms of Service and the Privacy Policy.
• The platform reserves the right to suspend or terminate a producer account if the producer violates these terms or applicable laws.

3. Products and Inventory Management

• The producer is responsible for the accuracy of uploaded product descriptions, prices, and availability.
• Product prices are gross prices (including VAT) expressed in HUF (Ft).
• Inventory management (supply pool) is the producer's responsibility — the specified quantity is available on a first-come, first-served basis.
• Only food and food ingredients may be listed. Listing non-food products is prohibited.
• The following may not be listed: tobacco products, alcohol (without a license), pharmaceuticals, illegal products.

4. Market days and confirmed reservations

• Producers join market days voluntarily — joining a market day means they undertake to appear on that day.
• Based on confirmed reservations, the producer must set aside the products for that market day and keep them available until the end of the pickup time window, or reject the reservation with a justified reason.
• Payment takes place at pickup, in person. The producer determines which payment methods are accepted.
• The producer must mark items that were handed over in person with the appropriate fulfilment status on the platform.

5. DSA Compliance (Digital Services Act)

Under Regulation (EU) 2022/2065 (Digital Services Act — DSA), Villámpiac qualifies as an intermediary service provider. Producers, as "traders," must comply with the following obligations:

• Traceability: the producer must provide and keep up to date their real contact details (name, address, email).
• Regulatory compliance: the producer declares that their products comply with EU and Hungarian food safety, consumer protection, and tax regulations.
• Accurate information: product descriptions and prices must be truthful and up to date.

6. Trust System

Producers may rate buyers based on their past experience (negative, neutral, trusted). Ratings and attached free-text notes are visible to all producers on the platform.

Ratings and notes must be provided in good faith, based on actual experience. Intentionally false or malicious ratings, as well as offensive notes or notes containing personal data, are prohibited.

6.1 Buyer Data Handling

When a reservation is submitted, the producer receives the buyer's name, email address, phone number (if provided), and reservation details.

• Data may only be used for organising pickup — marketing, resale, or any other use is prohibited.
• With respect to buyer data processed outside the platform, the producer qualifies as an independent data controller and must comply with GDPR requirements.
• Buyer data must be kept confidential and may not be shared with third parties.

7. Invoicing

The producer is required to issue legally compliant documentation (invoice, receipt) to the buyer. The platform offers an optional Számlázz.hu integration for automatic receipt generation, but its use is not mandatory.

8. Liability

• The producer is fully responsible for the quality, safety of their products and compliance with food safety regulations.
• The producer is responsible for complying with all legal obligations connected to the in-person sale (including consumer protection, taxation, invoicing, and food safety).
• The platform assumes no liability for legal disputes between producers and buyers.

9. Account Termination

The producer may request account termination at any time by contacting hello@villampiac.hu. Before termination, the producer must close or properly reject all confirmed reservations that are still open. After account termination, producer data is retained for the period required by law.

10. Applicable Law

These terms are governed by Hungarian law. For dispute resolution, the provisions of Section 9 of the Terms of Service apply.
